of Use for Website
Please read these terms and conditions carefully before ordering
your Experience as they form the basis of the contract between
us (Events Galore Limited) and you (the purchaser). If there
are any points on which you are unclear please contact us for
clarification before making a booking.
Definitions
1. The following expressions shall have the following meanings
in these terms and conditions:-

contents’ any information, data, graphics, links or computer codes published
on or contained within the Web Site

Experience’ the activity experience or premium events experience of any
service, activity or event the details of which are provided in the Web Site
‘
Experience Pack’ the confirmation of booking and pre-event
‘ Premium Event literature provided by us
Experience’
‘
purchaser’, ‘you’ the person, firm or company making the
booking with the company
‘

Web Site Descriptions
2. We have used every effort to ensure that descriptions
and illustrations of Experiences used in the Web Site or
in
any brochure or other literature provided by us are accurate.
Photographs give a general idea of the Experience and are
not intended to form part of the contract between us and
you. Where timings are stated, these are given as a guide
only and for activities involving several participants
there may be some waiting time involved.
Restrictions
3. Some Experiences have restrictions on the size, age and
health of
participants and where appropriate these will be stated in
the Web Site. You are required to notify us or our supplier
of any relevant medical conditions. If you are uncertain
whether restrictions will apply to an Experience you should
speak to us before making a booking.
Cancellations
4. We reserve the right to cancel or reschedule an Experience
due to unavailability of the activity, insufficient numbers
or other reasons beyond our control. If we cancel your
Experience we will tell you as soon as possible and use
all reasonable endeavours to offer an alternative date,
location or replacement event or activity as appropriate.
If we are unable to provide a satisfactory alternative
your payment will be refunded in full.
5. Some Experiences may be cancelled due
to weather conditions, mechanical failure, or for other reasons
beyond the control
of us or our supplier. Your Experience Pack will tell you
if you need to call the supplier of the Experience to check
whether conditions are suitable. If your Experience is cancelled
because of weather conditions, mechanical failure or for
other reasons beyond the control of us or our supplier, you
will be able to rebook for an alternative date. We are not
liable to reimburse you for travelling expenses, costs of
accommodation or other incidental expenses incurred by you
in attending an Experience which is cancelled for any reason.
6 If you need to change or cancel your booking we will use
all reasonable endeavours to re-assign the Experience. Where
we are unable to do so you may lose your booking and your
payment. If your Experience is being provided by a supplier
you will be subject to their cancellation policy and cancellation
charges.
7. Voucher for Activity Experiences
organized through our third party suppliers will have an
expiry date printed on
them and are normally valid for at least 9 months. The activity
should be booked and completed prior to the expiry date.
An extension to the validity period can often be arranged,
but a payment of an administration fee of £25 plus
any increase in the published price for the relevant activity
may be applicable.
Prices and Payment Terms
8. If you are booking one of our Premium Event Experiences
then we will require 50% of the price for your Experience
to be paid at the time of booking and your account with
us must be settled in full no late than 30 days before
the event date. For all other Activity Experiences payment
must be made in full at the time of booking.
9. Prices quoted in the Web Site or any
brochure material supplied by us and charges payable under
these terms and
conditions are inclusive of VAT
10. We reserve the right to change prices
without notice. We will not however change a price once the
initial payment
has been taken and the Experience Pack has been sent.
Liability
11. We accept liability for any loss or damage sustained
as a result of
the negligence of any staff employed directly by the company
in the course of providing any event or activity Experience
provided that notice of any claim is given in writing to
us within 7 days of the incident giving rise to it.
12. Some Experiences are provided by
suppliers who are neither
employed by nor agents of the company and although we use
all reasonable endeavours to satisfy ourselves of the quality
of the Experience supplied we are unable to examine all
equipment and facilities used by suppliers or to vet their
staff. We cannot therefore accept liability for any act
or omission or negligence of a supplier nor any other liability
arising out of their provision of activities and the supplier’s
own terms and conditions will apply, a copy of which will
be made available on request.
Problems
13. We take pride in the services that we provide and the
total care offered to our customers. Consequently problems
should only arise rarely. In the unlikely event that there
is a problem during your Experience please speak on the
day to either our representative on the site or to our
supplier, so that your problem can be resolved there and
then. Other complaints should be sent to us in writing
within 7 days of the incident giving rise to it.
Contractual provisions
14. These terms and conditions are governed by English law
and
fall within the jurisdiction of the English courts. They
do not affect your statutory rights as a purchaser.
15. All clauses of these terms and conditions
take effect independently and if one clause is unenforceable
this will
not affect the validity of the other clauses.
16. A person who
is not named as purchaser in the Experience Pack has no right
under the Contracts (Rights of Third Parties)
Act 1999 to enforce any terms and conditions.
